Terms of Use
These terms are an agreement between you and Dadacorn LLC ("we", "us") for the Dadacorn app and the dadacorn.app website. By installing or using the app, or using the site, you accept them. If you don't accept them, please don't use Dadacorn. If you are under the age of majority where you live, a parent or guardian must accept these terms for you.
1. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Dadacorn on devices you own or control, for your own non-commercial entertainment. The app is licensed, not sold. We keep all rights we don't expressly grant.
2. What you may not do
- Copy, modify, distribute, sell or rent the app or any part of it.
- Reverse engineer, decompile or disassemble the app, or try to extract its source code or the positioning technology inside it, except where the law expressly allows it despite this term.
- Use the app or its technology to build a competing product or service.
- Remove or change any copyright, trademark or other notice.
- Use the app unlawfully, or in a way that could harm others.
3. Playing safely
Dadacorn is played by laying devices on a table and moving them around. Use a flat, stable surface, handle devices with care, and keep drinks clear. Supervise young children. You are responsible for your devices and your surroundings while playing. To the extent the law allows, we are not responsible for damage to devices, loss or injury that happens while you play.
4. Purchases
If Dadacorn offers in-app purchases, such as extra games, image packs or skins, they are sold through Apple's App Store or Google Play and are subject to that store's terms, including its refund policy. A purchase gives you a licence to use the content within Dadacorn under these terms, not ownership of it. Prices and available content may change.
5. Our content
The app, its games, artwork, sounds, software and the Dadacorn name and logo belong to us or our licensors and are protected by intellectual property laws, including patents. Some artwork in Dadacorn reproduces works that are in the public domain.
6. Updates and availability
We may update, change or remove features or games, or stop offering Dadacorn, at any time. Some updates may be needed to keep using the app.
7. Disclaimer
Dadacorn is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Positioning depends on your devices, cameras, lighting and surroundings, and we don't promise it will work with every device, in every room, or without interruption or error.
8. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Dadacorn. Our total liability for any claim relating to Dadacorn is limited to the greater of the amount you paid us for the app and in-app purchases in the 12 months before the claim, or US$50. Some places don't allow these limits, so they may not all apply to you.
9. Ending these terms
You can stop using Dadacorn at any time by deleting it. If you break these terms, your licence ends automatically. Sections 2, 5, 7, 8 and 10 survive the end of these terms.
10. Governing law
These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law rules, and any dispute will be resolved in the state or federal courts located there. This doesn't take away any protection you have under the consumer laws of the country where you live.
11. App Store and Google Play
If you got Dadacorn from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies, and you agree that:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app;
- Apple is not responsible for claims relating to the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes someone's intellectual property; we are responsible for those to the extent these terms don't disclaim them;
- you are not located in a country subject to a U.S. Government embargo or listed on a U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you got Dadacorn from Google Play, Google Play's Terms of Service also apply to your use of the store.
12. Changes to these terms
We may update these terms. We'll change the date above and, for significant changes, tell you in the app or its release notes. Continuing to use Dadacorn after a change means you accept the updated terms.
